Listeners had several questions for our guest, not just about the moot court space debris problem, but more current space law issues with the Outer Space Treaty. Our guest explained that in the moot court program, consequences for the losing side do not exist. We then talked about the difficulty in assessing consequences and penalties in real space law litigation issues. Listen carefully, you do not want to miss this very realistic assessment of possible consequences for a "violating" space player.
Space tourism came up for both the moot court and for real issues. We talked quite a bit about the spaceflight participant designation and what it may mean. I asked Giugi about holding spaceflight participants at least partially liable for accidents and damages in space tourism accidents and incidents, as other space law guests have suggested over the years when they have been on The Space Show. Giugi thought it would be very difficult to hold a spaceflight participant accountable for anything that went wrong on a space tourism flight unless it could be shown that the participant did something to interfere with the spaceflight crew or cause the accident. Before the segment ended, Todd wanted to know if the moot court project was focusing more on commercial spaceflight due to the growth in the industry over the last several years and the rising influence of the NewSpace segment of space advocacy and commerce. She said yes but again, don't miss her full comments offered in reply to Todd.
In the second segment, Wanda asked about a federal court jurisdiction requirement in the recently passed 2015 Commercial Space Law Act. Another listener wanted to know about possible real life liability issues for academic payloads, say cubesat launches, for the students, the university and other related parties. Don't miss what Giugi said in response to these and other questions. This led to a discussion about not wanting to test the actions and behavior of private actors given precedents are not wanted. Near the end of our discussion, we talked about property rights and deep space mining resource utilization. Our guest had much to say on both property rights and using space resources but in short, she said we would have some sort of novel property rights some day and if the companies could develop asteroid mining, it could change the focus and balance of the entire Earth economy.
