John Batchelor and I welcomed Michael Listner, ATTY, back to the show to discuss the recently announced settlement in the SpaceX vs. USAF litigation around the block buy, SpaceX certification, etc. Michael took us through the origins of the law suit filed last year by SpaceX, the various motions to dismiss that were filed and the eventual settlement talks by both parties and the settlement reached about a week ago. Michael pointed out that nothing changed regarding the existing block buy of 36 core sole source contract buys awarded to ULA. The settlement did arrange for assistance to SpaceX to earn certification and for future bidding. Michael also provided us with his opinion as to a possible winner in the litigation or was there no winner. See what you think. Please post your comments/questions on TSS blog.
